Parade d'identification

La parade d’identification, séance d'identification ou tapissage, est une procédure par lequel la victime ou le témoin d'un crime peut confirmer l'identification d'un suspect pour pouvoir servir comme éléments de preuve au procès[1]. Elle a été inventée en Angleterre au XIXe siècle[2].

Le suspect est placé en compagnie de plusieurs autres personnes de taille, de morphologie et d'allure semblable appelés « distracteurs » (il peut s'agir de prisonniers, d'acteurs ou de volontaires). Cela se déroule parfois dans une pièce spéciale, possédant une échelle de taille sur le mur pour aider à identifier la taille de la personne. La personne qui doit faire l'identification se trouve derrière un miroir sans tain ou une protection équivalente, pour garantir qu'elle ne soit pas elle-même identifiée par le suspect.

Dans d'autre cas, on présente des photographies du suspect et d'inconnus au témoin pour identification-photo[3]. Si celui-ci reconnaît le suspect parmi les inconnus, l'identification est considérée comme valable. Certaines recherches évaluent d'autres méthodes qui impliquent que le témoin regarde les photos successivement plutôt qu'en même temps[4].

Pour qu'une parade puisse être admissible en cour comme preuve, elle doit être menée de façon équitable. La police ne peut rien dire ni faire qui persuade le témoin d'identifier le suspect qu'elle préfère. Ceci inclut le fait d'inclure dans la parade des personnes qui ne ressembleraient pas du tout au suspect[1].
