Un affidavit est un écrit dans lequel on déclare solennellement devant une personne autorisée par la loi, comme un commissaire à l’assermentation, que les faits qui y sont énoncés sont vrais.

Le terme affidavit vient du latin « il a déclaré sous serment » et est le plus souvent utilisé en droit anglo-saxon. En France, on parlerait plutôt d'une « déclaration sous serment ».
