n. f.

Manière dont une chose est constituée, dont ses éléments combinés forment un tout. La forme et la matière entrent essentiellement dans la constitution des corps. La constitution de l’air, ou La constitution atmosphérique. La constitution du monde.

Il se dit particulièrement du Tempérament et de la complexion du corps humain. Bonne, forte constitution. Constitution robuste. Constitution délicate. Il est de bonne constitution, de mauvaise constitution.

Il se dit également d’une Charte ou loi fondamentale qui détermine la forme du gouvernement et qui règle les droits politiques des citoyens. Donner, établir une constitution. La France a eu successivement plusieurs constitutions. Violer la constitution. La Constitution américaine.

Constitution civile du clergé, Organisation du clergé français, décrétée par l’Assemblée constituante, le 12 juillet 1790.

Il signifie, dans une acception plus étendue, Ordonnance, loi, règlement. On ne le dit guère qu’en parlant de Législation ancienne, ou en matière ecclésiastique. Les constitutions des empereurs. Les constitutions canoniques. La constitution ou bulle Unigenitus. Constitutions apostoliques. Les constitutions d’un ordre religieux.

Il se dit encore de l’Action de constituer, d’établir légalement. Constitution de rente. Un contrat de constitution. Constitution de dot.

En termes de Procédure, Constitution d’avoué, Déclaration que tel avoué occupera pour telle partie, dans un procès. Cette assignation est nulle, on y a omis la constitution d’avoué. Donner acte à un avoué de sa constitution, lorsqu’elle est faite à l’audience.
